Terms of Service

These Terms govern your use of Spot the Human. By playing, you agree to them. Please read them alongside our Privacy Policy.
1. Acceptance
By accessing or using Spot the Human (“the game”), operated by Bunduk (“we”, “us”), you agree to these Terms of Service. If you do not agree, please do not use the game. You can reach us at info@bunduk.com.
2. Eligibility and age
No account is needed to play, and the game is intended for a general audience. In the Netherlands the age of digital consent under the GDPR is 16; if you are under that age, you should use the game only with the involvement of a parent or guardian.
3. The game is free and provided “as is”
Spot the Human is provided free of charge. We give you a personal, non-exclusive, non-transferable and revocable licence to access and play it for your own non-commercial use. We do not guarantee that the game will always be available, uninterrupted or error-free, and we may change, suspend or discontinue any part of it at any time.
4. Acceptable use
When using the game, you agree not to:
- abuse, automate, scrape or place excessive load on the service, or attempt to bypass its rate limits or security;
- cheat, manipulate or submit fake entries to the leaderboard;
- submit unlawful, infringing, hateful or harassing content, spam, links, or other people’s personal data;
- impersonate others or choose a display name that is offensive, infringing or misleading.
We use anti-abuse measures such as rate limiting and content screening, and we may remove entries or block a device or display name that breaks these rules.
5. Content you contribute
If you contribute answers or choose a display name, you confirm that the content is yours to submit and that it is lawful and does not infringe anyone else’s rights.
By submitting content, you grant us a worldwide, royalty-free, non-exclusive, sublicensable licence, for as long as the law allows, to store, reproduce, adapt, publish and use that content to operate and promote the game. This expressly includes showing an approved answer as the “human” answer in puzzles played by others, and using submitted text as reference (“avoid this”) context when generating AI content, as described in our Privacy Policy.
All contributions are reviewed before publication. We may screen, edit, reject or remove any content at our discretion and without notice, and submitting content does not guarantee it will appear in the game.
6. Our intellectual property
We own or license the game itself, including its name, code, design, prompts, AI-generated content and the way it is put together. Except for the limited licence to play, no rights are granted to you. Product names and trademarks of our service providers belong to their respective owners.
7. Disclaimers and liability
The game is provided “as is” and “as available”, without warranties of any kind to the extent permitted by law. To the maximum extent allowed by law, we are not liable for indirect or consequential loss, or for any loss of data or game progress.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. In particular, we do not exclude liability for intent (opzet) or conscious recklessness (bewuste roekeloosheid), for death or personal injury, or any rights you have as a consumer under mandatory Dutch or EU law. Because the game is free, our overall liability is limited to the fullest extent the law permits.
8. Suspension and termination
We may suspend or end your access to the game (including a device, display name or entry) if you break these Terms or to protect the service. You can stop using the game at any time and clear your local data. Sections that by their nature should survive (such as the content licence you have granted, our intellectual property, the liability terms and governing law) continue to apply afterwards.
9. Changes to these Terms
We may update these Terms. When we do, we will post the updated version with a new date, and we will give reasonable notice of any significant change. If you keep using the game after a change takes effect, you accept the updated Terms; if you do not agree, you should stop using the game.
10. Governing law and contact
These Terms are governed by the law of the Netherlands, and disputes are subject to the competent Dutch courts, without depriving you, as a consumer, of the protection of mandatory rules or the courts of your own EU country of residence.
